Terms of Service

These Terms of Service ("Terms") govern your use of the Mise en Mémoire iOS application ("App") operated by Mise en Mémoire ("we," "us," or "our"). By downloading or using the App, you agree to these Terms.
1. Acceptance of Terms
By creating an account or using the App, you confirm that you are at least 13 years old and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.
2. Description of Service
Mise en Mémoire is a private fine dining journal for iOS. It allows you to document tasting menu meals with photos, ratings, wine pairings, voice notes, and course-by-course records. The App is intended for personal, non-commercial use.
3. Accounts
You must sign in using Apple ID (Sign in with Apple). You are responsible for maintaining the security of your account. You may not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription Plans
Mise en Mémoire offers three tiers of access:

Subscriptions are billed through Apple In-App Purchase. Prices are in USD and may vary by region. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. You may manage or cancel your subscription in your iPhone Settings → Apple ID → Subscriptions.
We do not offer refunds beyond Apple's standard refund policy. To request a refund, use Apple's standard refund process at reportaproblem.apple.com.
5. Free Tier Limits
Free accounts are limited to 3 meals per calendar month. Meals logged beyond this limit require an active Mise+ or Mise Pro subscription. We reserve the right to adjust free tier limits with reasonable notice.
6. Your Content
You retain full ownership of all content you create in Mise en Mémoire — including meal logs, photos, voice notes, tasting notes, and wine records (collectively, "Your Content").
By using the App, you grant us a limited license to store and process Your Content solely for the purpose of providing the App's features to you. We do not claim ownership of Your Content and do not use it for advertising, training AI models, or any other purpose beyond delivering the service.
You are responsible for ensuring that Your Content does not infringe the intellectual property rights of others (e.g., photographing a menu does not transfer its copyright to you).
7. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any regulations
- Attempt to reverse-engineer, decompile, or disassemble the App
- Use automated means to access or scrape the App
- Attempt to gain unauthorized access to our systems or other users' data
- Use the App to harass, harm, or impersonate others
- Circumvent subscription restrictions or attempt to unlock paid features without payment
8. OCR and AI Features
Mise+ and Mise Pro include an OCR menu scanning feature powered by the Anthropic Claude API. Accuracy of extracted course names depends on the quality and legibility of the scanned menu. We make no guarantee of accuracy and are not liable for errors in OCR output. You remain responsible for reviewing and correcting scanned content before saving.
9. Intellectual Property
The App, including its design, interface, code, and branding, is the intellectual property of Mise en Mémoire and is protected by copyright and other applicable laws. Nothing in these Terms grants you a right to use our trademarks, logos, or trade dress.
10. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Mise en Mémoire shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or goodwill, arising out of or related to your use of the App — even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice, if we believe you have violated these Terms. Upon termination, your right to use the App ceases immediately. You may request deletion of your data as described in our Privacy Policy.
13. Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of laws principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above. Continued use of the App after changes constitutes your acceptance of the revised Terms.
